Information regarding the failure by the Accredited Representative of the Republic of Poland to exercise its rights under point 5.25 of Annex 13 to the Chicago Convention

Request for written justification of all decisions refusing access to documents and information

On 29 July 2010 the Russian party provided a response to the Accredited Representative of the Republic of Poland, with among others the following information:

- the Polish party was granted access to the location of the accident and also other objects at the Smolensk "Severny" aerodrome;

- inspections were carried out jointly and an outline of the debris from the aircraft as well as an analysis of damage - with the participation of Polish representatives, readings were taken from ground and board control as well as TAWS and FMS.

Copies [SCND: not the original recorders containing this data were] provided to the Polish party. The [SCND: copies of] recordings on the flight recorder of the flight parameters were read in Poland;

- representatives of the Polish party participated in hearings with persons fulfilling functions at the Smolensk "Severny" aerodrome who were in charge of flight safety enforcement.

- The Polish party was provided with copies of these hearings and written explanations were provided in response to additional questions;

- at the place of the accident the Accredited Representative of the Republic of Poland participated in daily clearance;

- in the registered office of IAC representatives of the Polish party participated in an initial analysis of data from the flight recorders; The Accredited Representative of the Republic of Poland signed preventative recommendations;

- At a special meeting the Polish party was presented with the results of the test flight of the aerodrome's radio technical equipment and the results of a reading of TAWS and FMS data;

- the Accredited Representative of the Republic of Poland and a Polish specialist participated in the preparation of an evaluation of the psychological and emotional state of the crew of the aircraft [SCND: These "psychological profiles" were later proven to disengenuine and fabricated by the Russian side with the acquiescence of Donald Tusk administration and Polish Military Prosecutors' Offic]

- an experiment was carried out in a simulator in which the Accredited Representative of the Republic of Poland participated,

- the Accredited Representative of the Republic of Poland received copies of many documents [SCND: not the originals] relating to issues (reports by senior officers, data from the flight of the aircraft in the zone of responsibility of Russian and Belorussian flight control, data concerning weather forecasts and actual weather conditions, aero navigational and other data).

In addition the Russian party asserts that the Accredited Representative of the Republic of Poland and his advisers had the opportunity to read the contents of other documents relating to this issue.

The position of the Russian party will be included in the draft final report and sent to the Polish party, who will have 60 days to submit its comments to the draft.

Since most of the replies to the questions of the Polish party and the request for documents relate to the competence of the Ministry of Defence of Russia and restrict the access, decisions concerning their availability shall be taken by relevant bodies responsible for law enforcement.

Explanation as to why despite many shortcomings in the equipment of the Smolensk "Severny" aerodrome confirmed during the test flight at this aerodrome of 5 April 2010, in order to accept special flights a consent was granted for the landing of aircraft with VIPs on board - fflights designated "A"
The shortcomings include:

- at the aerodrome there is no control tower (KDP) and flights are directed with SKP (Starting Point of Command), why does the CATC have no possibility of controlling the situation on the ground of the aerodrome

- The list of equipment is not entirely consistent with the standards for operation of a state aerodrome (FAP NGEAGosA- 2006) or the Instruction for Operation of Aerodromes in the scope of radio electronic apparatus (FAP REA-2006);

- At the work station of the Landing Zone Controller there is no metric display on the RSL radar station. The command headquarters of the aerodrome there was no such equipment;

- several persons in the CATC Group have access to such instruments;

- objective control equipment (3 P-500 tape recorders and magnetic tape) according to the technical state do not comply with the requirements pursuant to normative documents and should be written down.

Polish Air Crash Unanswered Questions, Requests for Assistance Submitted to the Russian Federation
Smolensk Maze, 2014 Status Report by Maria Szonert Binienda

"Russian Image Management"

The trip to Smolensk was expected to highlight Russia finally admitting culpability in the massacre, after long having blamed it on the Germans, an atrocity they had tried to conceal for over 70 years.

Eugene Poteat, retired CIA Senior Scientific Intelligence Officer.

As for the reception committee, it had different ideas. Putin wasn’t looking forward to such an occasion. Into this poisonous reception brew was President Kaczynski’s well-known public criticism of Moscow and Putin, a habit that has ended the lives of others within Russia – and abroad. A few discouraging Russian requirements – that Kaczynski could not attend in any official capacity – did not halt the Poles. Kaczynski would go anyway on non-official, “personal” business. To Russians, such a distinction would be meaningless, not lessening the possible international excoriation of such an event. A problem ripe for a modern, Russian solution: a tragic, ‘natural’ accident.

Smolensk Crash Timeline

Timeline of events leading to the death of President of the Republic of Poland, Lech Kaczyński, and Polish government delegation near Smolensk, Russia, on April 10, 2010.

1. April 9, 2009 - Polish MON [Pol. abbr. Ministry of National Defense - Ministerstwo Obrony Narodowej] signs a contract concerning the repairs and renovation of two Polish Tu-154 planes. A consortium of MAW Telecom and Polit Elktronik firms wins the tender worth more than 69 million zloty. The second one of these companies isn't even registered with the CSR, and thus, should have been automatically disqualified from bidding. Furthermore, Polit Elekronik represents the interests of Russian arms manufacturers and has close relationship with Russian intelligence services.

For reasons that are impossible to explain, the offers made by other bidders are rejected; among those, are Metalexport-S, and the government-owned Bumar enterprise.

As reported by the Air Agency "Altair", the MON chose a contractor without any analysis of other bid proposals. The owner of the [Aviakor, (Rus. Авиако́р)] Samara repair plant chosen by the consortium is Oleg Deripaska [Rus. Оле́г Влади́мирович Дерипа́ска], who was investigated by the Western prosecutors on suspicion of money laundering and contacts with the "Russian Mafia" and who had his visa to the US revoked from 2006-2009. The Tupolev's engines, on the other hand, are overhauled in the factories managed by Sergey Chemezov [Sergey Viktorovich Chemezov, Rus. Серге́й Ви́кторович Чемезов], a former KGB agent, who form 1983 to 1988 worked undercover in Drezden. He lives next door to the president of Russia - Vladimir Putin. None of the Polish special services representatives were present during the critical engines' overhaul.

2. April 2009 - During a TV interview for Gazeta.pl, Janusz Palikot, then a deputy PO states: "In the event that Lech Kaczyński is unable to fulfill his duties until the end of his term, someone must be found, who is [perceived to be] playing outside of the playing field [...] Because of the constitutional role played by the Marshal [Bronisław] Komorowski, who is designated as a person who in the event of the death of the president is to take over the Polish presidency, it is prudent that it isn't perceived as a play, but as the Marshal's [legitimate] constitutional right [and duty]."

3. May 2009 - In the interview with RMF FM, Bronisław Komorowski states: "I do not pretend to be a seer or prophet [...] Coming presidential elections, the president [Lech Kaczyński] will be flying somewhere and it will all change".
